I filed my objection with the DG, ASI, vide my letter dated 16-11-2009 stating that our
adjacent house, i.e..C-97, as well as C-103, which is on the other side of the house have been
granted similar permission and therefore our case too merits a similar sanction.
4) On a perusal of the minutes of the 23rd Meeting of the Expert Advisory committee held on
18th and 19th August 2009, which is on the ASI website. I find that permission to our adjacent
house C-97, Shivalik, has been granted on the basis of the following information which is
recorded in the minutes.
- Distance from protected monument – 38 m.
(Surprisingly, our house which is adjacent to C-97, has been stated to be
at a distance of 19 m. vide ASI’s rejection letter).
- North C-98 (Our house) Residential building with 14.50 m. height, which is
fraudulent and wong.

(Our house is only 10.26 m. high. We now propose to build
the 2nd Floor).
- South (C-96) Residential building with 14.50 height,again fraudulent and wrong.
(Its built upto First Floor Only around 10 m.)
- East – Service lane + Residential Building 12.50 m height
- West – Road & Park
5) In our case the facts are similar. In fact the house on our north, i.e. C-99, Shivalik,
New Delhi, already has a full Second flooor constructed and the house on the South,
i.e. C-97, the 2nd Floor construction has started.
To sumarise, both our adjacent houses i.e.C-99 on North (2nd Floor already constructed) and
C-97, on South (2nd floor under construction) will be constructed upto the 2nd Floor.
Why then deny us i.e. C-98, the permission?
